35mm Portrait Photography Terms and Conditions

By booking a session with Jite Birhire Photography, you acknowledge that you have read, understood, and agreed to these terms and conditions.

Services Offered:

  • Jite Birhire Photography agrees to provide professional photography services using 35mm film, specialising in portrait photography.

  • Services include but are not limited to individual portraits, family portraits, and event portrait sessions.

Photographs Provided:

  • Jite Birhire Photography will provide no fewer than 25 edited images to the Client after the shoot.

  • The selection of images delivered to the Client is at the sole discretion of Jite Birhire Photography.

Satisfaction Guarantee:

  • If Jite Birhire Photography fails to deliver the specified usable images, Jite Birhire Photography will offer a complimentary reshoot.

Client Cooperation:

  • The Client shall assist and cooperate with Jite Birhire Photography in obtaining the desired photographs, including posing as directed by Jite Birhire Photography.

  • Jite Birhire Photography is not responsible for photographs not taken due to the Client’s failure to provide reasonable cooperation.

Post-Processing and Delivery

Editing

Jite Birhire Photography will perform basic post-processing or analogue image editing on photos where artistically necessary.

  • Delivery Time:

    • Standard Delivery: within 30 days.

    • Rush Delivery:

      • colour photos: within 1 week.

      • Black & white photos: within 2 weeks.

      • Rush delivery is subject to a 20% additional fee.

  • Rush delivery fees apply to each individual rush request and are calculated per photography session. The rush delivery fee is 20% of the final session cost, added to the final invoice amount.

  • Delivery Method: The Client will receive photos via Google Drive or WeTransfer, with the link available for 14 days before it is disabled.

  • Editing Limitations: The Client agrees not to edit the photos when publishing them online.

Payment Terms

  • Retainer: A non-refundable retainer of 50% of the total fee is required to reserve the date.

  • Remaining Balance: Due two days before the photography session date.

  • Rescheduling Penalty: Changes are allowed up to 10 days in advance. A €115 penalty applies for rescheduling within 10 days of the session.

Photographer's Liability

  • Jite Birhire Photography cannot guarantee specific poses or coverage quality due to interference from third parties or environmental factors.

  • Jite Birhire Photography is not responsible for photographs not taken due to the Client’s failure to provide reasonable cooperation.

  • If unforeseen circumstances prevent Jite Birhire Photography from performing the services, Jite Birhire Photography will refund all payments made by the Client.

Image Retention and Backup

  • Jite Birhire Photography will retain copies of photos from the shoot for 365 days after delivery.

  • After this period, Jite Birhire Photography has no obligation to retain original files or photos.

Photographer's Usage Rights

  • Jite Birhire Photography retains ownership and copyright of all images captured during the photography session.

  • The Client is granted a limited license to use the images for personal purposes only. Commercial use requires prior written consent from Jite Birhire Photography.

  • Requests to purchase negatives or unedited photos will be evaluated individually. Additional fees apply for such a premium offer.

  • The Client agrees to allow Jite Birhire Photography to use the images for promotional purposes, including website, social media, and portfolio use. If the Client wishes to withhold permission, they must inform Jite Birhire Photography in writing before the session.

Injury and Damage Indemnity

  • The Client agrees to indemnify and hold Jite Birhire Photography harmless for any injury, damage, or loss related to the photography session. This includes any injury or damage caused to the Client or their property during the session.

  • Jite Birhire Photography is not liable for injuries or damages occurring during the session to the Client, the Client’s property, or third parties.

Quality and Subjectivity

  • The Client understands that the quality of a photograph is subjective. Jite Birhire Photography is not obligated to cater to the client's specific aesthetic preferences.

Analog Failures

  • The Client agrees to indemnify and hold Jite Birhire Photography harmless for any liability, damage, or loss related to analogue failures, including issues with film development, scanning, or lab-related errors.

  • Jite Birhire Photography will take reasonable steps to prevent data loss but is not liable for data loss due to technical failures.

Photographer's Discretion

  • Jite Birhire Photography retains the right to omit any image. Not every exposure taken will be delivered.

Client Responsibilities

  • The Client is responsible for providing accurate and timely information, including specific requests or preferences for the photoshoot.

  • The Client must ensure that all individuals involved in the shoot act respectfully and cooperatively toward Jite Birhire Photography.

Additional Expenses

  • Any additional expenses, including travel, accommodation, or equipment fees for locations outside Jite Birhire Photography’s regular operating area (Dublin), will be covered by the Client. Travel fees will apply for locations outside Dublin, and specific terms will be arranged in advance.

Privacy

  • Jite Birhire Photography agrees to handle all personal information provided by the Client, such as email and phone numbers, confidentially. Personal data will be used solely for booking and delivery purposes and will not be shared with third parties.

Social Media Posting and AI Training Opt-Out

  • The Client is encouraged to review the privacy settings on their social media platforms. When posting any images from the photography session on Instagram or Facebook, the Client may want to consider opting out of allowing Meta to use their content to train AI models. Force Majeure

  • Jite Birhire Photography is not liable for any failure to perform services due to causes beyond their reasonable control, including but not limited to natural disasters, accidents, illness, or other unforeseen events. In such cases, all payments made by the Client will be refunded, or the session will be rescheduled at the earliest possible date.

Feedback Period

  • The Client has 10 days from the date of photo delivery to provide feedback. After this period, any additional editing requests will incur an additional fee based on the scope of work.

Print Quality Disclaimer:

  • Jite Birhire Photography is not responsible for the quality of prints produced by third-party providers, as variations in colour, contrast, and sharpness may occur. The Client agrees that Jite Birhire Photography is not liable for any claims regarding the quality of prints obtained from other vendors.

Newborn Session Flexibility:

  • Due to the unpredictable nature of newborn arrivals, flexibility will apply for booking newborn sessions. The Client's due date may be pencilled in, but the final session date will be confirmed after birth. To ensure an ideal newborn session window (10-28 days old), the Client should notify Jite Birhire Photography within the first 2-3 days following the baby's birth to secure a final booking date. Delays in notification may limit session availability within the preferred timeframe.

Return Policy:
